HOUSTON – The attorneys at the Walker Texas law firm continue their efforts to help insured Hurricane Ike victims find recourse months after the devastating storm that resulted in more than 730,000 insurance claims filed.
Although insurance companies have settled between 60 to 80 percent of the claims as of December 10th, thousands more remain unresolved – leaving many Texans homeless and increasingly frustrated.
"We have had victims contact us daily saying that they have yet to see any insurance dollars to aide in their recovery. We can’t understand why some of our clients are still living in tents when they have insurance, or why others have had multiple adjusters come out, but still no insurance check," stated Attorney Jim Walker.
"Hurricane Ike victims have been wrongfully denied claims, offered insufficient payments – if any at all, and forced to turn to legal support for assistance in navigating the process. The Texas Insurance Code states that an insurance company must promptly handle and bring forth a fair and prompt settlement for damages. We’re working to ensure that this happens and that there are consequences if it does not," added Walker.
In an effort to help bring homeowners and insurance companies closer together in the settlement process, The Texas Department of Insurance is reportedly looking into mediation programs. Mediation programs like those that exist in other hurricane-prone states such as Florida, Mississippi and Louisiana bring in a third party in order to examine and attempt to resolve a claim between insurer and homeowner. Though, neither party is bound by the decision and litigation would remain an option.
